MATTHEW L. BUNNELL

Since clerking for the Honorable Charles R. Simpson III in the United States District Court for the Western District of Kentucky from 2020–2021, Matthew has built a practice focused on business and commercial litigation. Matthew represents a wide range of clients, including local businesses, school districts, and national companies, guiding them through complex disputes with a strategic and solutions-oriented approach.

Matthew views litigation as a chess match—success requires foresight, patience, and a well-executed strategy. His clients trust him to anticipate challenges, think several moves ahead, and remain unwavering in his dedication to secure the best possible outcome. Outside of work, family is Matthew’s top priority. He spends much of his free time with his parents, Terry and Debbie, grandparents, Paul and Louise, and younger brother, Jonathan, and his wife, Taylor. An avid athlete, Matthew enjoys playing whatever sport is in season, whether it’s basketball, pickleball, tennis, or logging miles on a run. He is also deeply involved with his alma maters, serving as President of the Louis D. Brandeis School of Law Alumni Council and Vice President of the Western Kentucky University Young Alumni Council.

REPRESENTATIVE MATTERS
  • Successfully defended the appeal of the Jefferson Circuit Court’s ruling that dismissed plaintiffs’ request for injunctive and other relief since the court could not proceed with a moot, unripe controversy.
  • Obtained dismissal in favor of a school board regarding a host of negligence and breach of contract claims.
  • Obtained dismissal in favor of a school board regarding a host of negligence claims.
  • Represented a large transportation company to enforce a pre-litigation resolution agreement.
  • Successfully defeated a motion for discretionary review following the Court of Appeals of Kentucky’s decision affirming dismissal of all claims asserted against defendants.
  • Represented a large transportation company in a breach of contract dispute concerning liability for charges and other expenses imposed in connection with cargo shipment.
  • Obtained dismissal in favor of a national financial institution concerning allegations that it permitted an unauthorized withdrawal from accounts of a deceased individual.
  • Represented a large transportation and shipyard company in a breach of contract dispute.
  • Obtained dismissal of an action filed with the National Labor Relations Board for lack of jurisdiction.
  • Obtained summary judgment in favor of an administrator regarding causes of action for quiet title and reformation of a deed.
  • Represented several public-school districts in a constitutional challenge to legislation authorizing near dollar-for-dollar tax credits to fund the payment of private school tuition and expenses.
  • Obtained dismissal of appellant’s appeal to the Court of Appeals of Kentucky in a jurisdictional child custody dispute.
  • Obtained declaratory judgment at the trial court level following a successful appeal to the Court of Appeals of Indiana.
  • Secured preliminary injunctive relief in favor of a large liquor company in an action alleging trademark infringement and unfair competition concerning its trademarks.
  • Represented a Homeowners Association in an action concerning failures of local official and entities to complete certain roadways.
  • Obtained summary judgment in favor of several school employees regarding numerous negligence and defamation causes of action arising from allegations that the school employees failed to provide a safe learning environment free of bullying and harassment.
  • Obtained summary judgment in favor of a school board regarding plaintiffs’ claims under 42 U.S.C. § 1983 as well as other state statutes and regulations.
